These Terms of Service ("Terms") govern your access to and use of the website join.pcrleads.com (the "Site") and the marketing and lead generation services (the "Services") provided by PCR Leads, a brand operated by PCR Ventures LLC ("PCR Leads," "we," "us," or "our"). By accessing the Site, submitting an application, or purchasing the Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or the Services.
1. The Services
PCR Leads provides done-for-you marketing and lead generation services for personal car rental businesses, which may include paid advertising management, landing page creation, lead qualification, CRM setup, and related consulting. The specific scope, deliverables, and pricing of your engagement are described at checkout, in your onboarding materials, or in a separate written agreement, each of which is incorporated into these Terms.
2. Eligibility
The Services are offered to businesses and business owners only. By using the Services you represent that you are at least 18 years old, that you are entering these Terms on behalf of a business, and that you have authority to bind that business.
3. Fees, Billing, and Ad Spend
- Service fees are stated at checkout or in your written agreement and are billed in advance on a recurring basis unless otherwise stated.
- Advertising spend (for example, budgets paid to Meta or other ad platforms) is separate from our service fees, is paid by you directly to the ad platform, and is your sole responsibility.
- Unless otherwise agreed in writing, engagements have an initial commitment period stated at signup and continue month-to-month thereafter until cancelled.
- You authorize us and our payment processor to charge your payment method on file for recurring fees. Failed payments may result in suspension of the Services.
4. Cancellations and Refunds
You may cancel future renewals at any time after any initial commitment period by giving us written notice before your next billing date. Except where required by law or expressly stated in a written guarantee at the time of purchase, fees already paid are non-refundable, as our costs (labor, setup, and campaign work) are incurred up front. Amounts paid to third-party ad platforms are never refundable by us.
5. Your Responsibilities
- Provide accurate, complete information about your business, fleet, and offers.
- Maintain any accounts, licenses, insurance, and legal compliance required to operate your rental business.
- Respond to leads promptly. Lead outcomes depend heavily on your follow-up speed and sales process.
- Comply with all laws applicable to your marketing and communications, including the TCPA and applicable SMS/calling rules, when contacting leads.
- Not use the Services for any unlawful, deceptive, or infringing purpose.
6. Account Ownership
Unless otherwise agreed in writing, you own your ad accounts, your CRM data, and the leads generated for your business during the engagement. We retain ownership of our internal processes, templates, systems, know-how, and any materials we developed prior to or independently of your engagement.
7. No Guarantee of Results
Marketing performance depends on factors outside our control, including your market, your offer, your pricing, your follow-up, ad platform behavior, and seasonality. Any figures on the Site (including lead counts, costs per lead, or revenue examples) are illustrations of past client results and are not promises of future performance. Except for any written guarantee expressly stated at the time of purchase, we do not guarantee any specific number of leads, bookings, or revenue.
8. Third-Party Platforms
The Services rely on third-party platforms (such as Meta, Google, Stripe, and CRM providers). We are not responsible for their availability, policy changes, account restrictions, or pricing. If a platform restricts or disables an account, we will use reasonable efforts to assist, but we are not liable for resulting losses.
9. Testimonials and Portfolio Use
With your permission, we may reference your business name, results, and feedback in our marketing. You may revoke this permission at any time by emailing us.
10. Disclaimer of Warranties
The Site and Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, PCR Leads and PCR Ventures LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data. Our total aggregate liability arising out of or relating to the Site or Services will not exceed the service fees you paid to us in the three (3) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless PCR Leads, PCR Ventures LLC, and their owners and personnel from claims arising out of your business operations, your rental agreements with customers, your violation of law, or your breach of these Terms.
13. Termination
We may suspend or terminate the Services for non-payment, abusive conduct, unlawful use, or material breach of these Terms. Sections that by their nature should survive (including Sections 6, 7, and 10 through 15) survive termination.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict of law rules. The parties will first attempt in good faith to resolve any dispute informally. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Georgia, and each party consents to their jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the latest version. Material changes will be communicated by posting on this page, and continued use of the Services after changes take effect constitutes acceptance.
